This section of the web site is intended to provide concerned neighbors and citizens with the most recent plans pertaining to the Phantom Creek Ranches proposed development. A community hearing will be held at the Pines and Plains library in Elizabeth on January 6th at 6PM to collect feedback from the community.
The final plat incorporates seven lots of 10+ acres each plus 33 acres of open space. Each lot will have building envelopes established to maintain suitable buffer between any structures built near neighbors and the open space. The Lot 7 building envelope is designed to keep all structures away of the area prone to retaining water. The water level within the retired gravel pit will be managed by regrading the surface to allow excess water to exit under Phantom Creek Drive through four 32 inch culverts. The proposed development will be completed in two phases, the 7 lot major development on the north side of the property and the two lot minor on the south. Since the existing house plus the lot to the west will not be sharing the newly constructed Phantom Creek Drive, phase 2 will not be included in the proposed Home Owners Association. The HOA for Phase 1, seven lot filing, will be responsible for maintaining the road and the open space. Phase 2 incorporates an existing driveway directly off County Rd 21 plus a new driveway for lot 1.
Elbert County's process for minor developments is done through an administrative process without the requirements for public meetings and multiple reviews by the Planning Commission and County Commissioners. A mailing plus sign posting will be provided to notify the neighbors when the administrative decision is scheduled, allowing time for public input.
Several years ago a friend of the property owner was allowed to use the retired gravel pit in lot 7 to teach weapons safety and concealed carry permits. The site was used for around 4 years with a total range use of about a dozen times. The bullets fired into three separate soil berms remain in place and when tested, four of the test locations showed levels in excess of EPA and CDPHE (Colorado Dept of Public Health) limits.
Remediation efforts are currently underway with a clean-up plan submitted and approved by CDPHE. Elbert County Public Health department has been informed and has copies of all studies, engineering reports and remediation plan. The developer has contracted with an environmental remediation and waste disposal company. The removal and disposal of soils containing lead bullets will be completed as soon as scheduling and weather allow. No date for remediation has been set yet, but the county requires remediation prior to completion of the development to assure the site meets EPA and CDPHE safe standards for residential areas.
